Supreme Court Hesitates to Exclude Immigrants from 2020 Census

Conservative justices were annoyed when Trump administration lawyers couldn't provide specifics about the census exclusion.

The Trump administration’s plan to exclude 10.5 million undocumented immigrants from the 2020 census is currently being considered by the U.S. Supreme Court. Jeffrey Wall, the administration’s top lawyer, struggled to defend the position and could not provide a number of how many undocumented immigrants the administration identified for exclusion. Justice Samuel Alito, who appeared annoyed, mentioned in Monday arguments that there are only 31 days left in the year to remove 10.5 million undocumented individuals from the census, making for a “monumental task.” Wall said the administration might only look to rule out small groups of undocumented immigrants, such as those in ICE custody. If the exclusion becomes just about small groups of undocumented immigrants, the legal challenges from states and immigrant rights groups could become, “much ado about very little,” Alito said. Trump’s recent nominee to the court, Justice Amy Coney Barrett, noted that “illegal aliens have never been excluded” from the census. This policy could affect states’ congressional apportionment, electoral votes and the distribution of $1.5 trillion in federal funds. USA Today
