A Manhattan federal judge said Tuesday that U.S. Immigration and Customs Enforcement is not complying well with his March injunction that ordered the agency to arrest fewer immigrants. Judge Alvin K. Hellerstein had asked ICE to provide reports about its arrest activities in the New York City area after his injunction, and said since March 30, ICE has detained 81 of 83 people it has taken into custody. “I don’t think there has been good compliance by the government,” Hellerstein said. The case that led to Hellerstein’s order was brought by the Bronx Defenders and the New York Civil Liberties Union. Law 360 (paywall)

Daughter of Haitian Immigrants Will be Next New Jersey Supreme Court Justice

Fabiana Pierre-Louis, a daughter of Haitian immigrants, may become the first Black woman to sit on New Jersey’s state Supreme Court. Pierre-Louis would also be the only Black judge currently seated on the court. Pierre-Louis is a former U.S. attorney in the state, and was nominated to the court by Gov. Phil Murphy (D). She grew up in Irvington, New Jersey, where her father drove a cab and her mother transported people at a New York City hospital. Pierre-Louis spoke Creole before she learned English. The New York Times

NYCLU Sues Trump for NYC Families of Asylum Seekers

The New York Civil Liberties Union sued the Trump administration on Tuesday on behalf of several asylum seekers who are stranded in Mexico, as well as their relatives who live in the U.S. The NYCLU’s suit argues the government lacks authority to return those people to Mexico under its Migrant Protection Protocols, or Remain in Mexico policy, because they were already found in the U.S. The lawsuit was filed in Brooklyn federal court. It notes the dangers asylum seekers face in Mexico, and alleges “racial animus” motivated the government to return them there. Law 360

Advocates Call on New Jersey Governor to Put Aid for Immigrants in Budget

Advocates are calling on New Jersey Gov. Phil Murphy (D) to include funding for immigrants in the state budget after they were left out of federal coronavirus relief packages. A draft state budget was released on Tuesday and it included several wins for Democrats in the state, as it included funding for programs aimed at helping economically distressed families in the state. Absent, however, were benefits aimed at helping the state’s immigrants. Patch
